If you purchased Magic Money for the Astroworld Festival, November 5-6, 2021, in Houston, Texas you could get a refund from a class action settlement.

A settlement has been reached with Magic Money LLC, Ceremony of Roses, LLC, Cor Merchandising, LLC, Scoremore Holdings, LLC, Live Nation Worldwide, Inc., and Live Nation Entertainment, Inc. (“Defendants”) in a class action lawsuit about the purchases of Magic Money intended for use at the Astroworld Festival, scheduled from November 5-6, 2021, in Houston, Texas (“Festival” or “Astroworld Festival 2021”). The settlement provides certain refunds and reimbursements to those who purchased Magic Money for the Festival.

The United States District Court for the Southern District of Texas will have a hearing to decide whether to give final approval to the settlement so that the refunds and reimbursements can be issued. Those who qualify to receive a refund or reimbursement from the settlement have certain legal rights and options, such as excluding themselves from or objecting to the settlement.

The class action lawsuit alleges Defendants owe a refund to those who purchased Magic Money intended for use at the Festival, particularly after the Festival was canceled due to a mass casualty event. However, the settlement does not imply that Defendants violated any laws or did anything wrong. Defendants deny any wrongdoing.

WHO IS INCLUDED?

The Settlement Class includes nearly everyone who purchased Magic Money for the Astroworld Festival 2021 and was not issued a chargeback or refund for their Magic Money purchase. Settlement Class Members are those who are part of the Settlement Class.

WHAT DOES THE SETTLEMENT PROVIDE?

The settlement provides for an automatic refund of Settlement Class Members’ Magic Money purchases for the Festival mainly paid with debit and credit cards. These refunds are to be made directly via the original payment method that was used.

If Settlement Class Members purchased Magic Money with cash or any payment means other than debit or credit card and did not receive an automatic refund, then they must submit a claim for reimbursement. The claim must include the amount of each purchase and the payment type and account number used for each purchase of Magic Money for the Festival.

No refund or reimbursement shall be provided if a chargeback or refund was previously received on the transaction.

Such refund or reimbursement shall be issued to Settlement Class Members upon final approval of the settlement and after the expiration of the deadline to object to or be excluded from the settlement and any appeals have been resolved.

Settlement Class Members need only submit a dispute to Settlement Class Counsel if there is a dispute over a refund or reimbursement of a valid claim. Documentation of a dispute must include the amount of each purchase and the payment type and account number used for each purchase of Magic Money for the Festival. Settlement Class Counsel will determine, on a “more likely than not” basis, whether the documentation submitted validates the claim.

Refunds and reimbursements will be reduced proportionally based on several factors, such as the amount of the settlement fund after attorney fees, costs, expenses, and incentive awards have been deducted and the expenses and costs and other considerations of the method of distribution.

WHAT ARE YOUR OTHER OPTIONS?

If you do not want to be legally bound by the settlement, you must exclude yourself by October 15, 2023, or you will not be able to sue, or continue to sue, Defendants about the legal claims this settlement resolves, ever again. You can exclude yourself from the Settlement Class by signing and submitting by mail or email a written notice of an intent to be excluded. If you exclude yourself, you cannot get any benefits from the settlement. If you stay in the Settlement Class, you may object to it by October 15, 2023.

The Court will hold a hearing in this case, known as Brenda Wong, et al. v. Magic Money LLC, et al., No. 4:21-cv-04169, on December 1, 2023, to consider whether to approve the settlement, and a request by Class Counsel for attorney fees, costs, and expenses of $85,925, and incentive awards of $200 for representative plaintiffs who filed the class action lawsuit. You or your own lawyer may ask to appear and speak at the hearing at your own cost, but you do not have to.
